In July 2020, Shenyang Intermediate People's Court in Liaoning Province rendered a ruling against enforcement of two South Korean judgments, due to the expiry of limitation period.
The Shanghai First Intermediate People's Court ruled in 2020 to recognize and enforce a judgment rendered by the Seoul Southern District Court of South Korea. Once again, the China-South Korea reciprocal relationship was confirmed, thus keeping the door wide open for more South Korean judgments.
"Opinions on Further Providing Judicial Services and Safeguards for the Construction of the 'Belt and Road' by People's Courts" (关于人民法院进一步为“一带一路”建设提供司法服务和保障的意见) was issued by China's Supreme People's Court on 27 Dec. 2019.
List of China's Bilateral Treaties on Judicial Assistance in Civil and Commercial Matters (Enforcement of Foreign Judgments Included)
Full texts of China's bilateral treaties on recognition and enforcement of foreign judgments and other judicial assistance matters are now available. The information comes from the website of the PRC Ministry of Foreign Affairs.
To date, we have collected 57 cases involving China and 20 foreign States and regions in the field of recognition and enforcement of foreign judgments. (Note: Foreign divorce judgments are excluded.)
The Arnhem Leeuwarden Court of Appeal, Netherlands, ruled in 2015 to recognize and enforce a Chinese judgment, which marks the first time that a Dutch court has recognized a Chinese monetary judgment.
The case also marks the first time that a Singapore judgment has been recognized in China since the signing of China-Singapore Memorandum of Guidance in 2018.
