The Notice on Strengthening the Protection for Well-known Trademarks in Cases of Trademark Infringement was promulgated on 15 Nov. 2019.

The Notice consists of three parts, which aim to stipulate how should the IP administrative authority protect well-known trademarks in cases of trademark infringement.

The key points are as follows:

  1. Trademark infringement cases involving the protection for well-known trademarks shall be under the jurisdiction of the IP administrative authority at or above the municipal level.

  2. The IP administrative authorities of all localities shall summarize well-known trademarks that have been recognized as so by the administrative authorities and continue to be used within their jurisdiction, and the National Intellectual Property Administration will establish a database on this basis.
