Trade Union Law was promulgated in 1992, and amended in 2001, 2009 and 2021 respectively. The latest revision entered into force on 1 Jan. 2022.

The Law consists of 58 articles, aiming to determine the rights and obligations of a trade union.

The key points are as follows:

1.Can foreigners employed in China join trade unions?

Yes.

You have the right to join trade unions as long as you are earning your living primarily from wages in an employer within China. (Art. 3)

2.Can trade unions help workers collect their wages?

Yes.

Besides, trade unions should represent employees to negotiate with their employers in cases where employers arbitrarily extend working hours (e.g. 996 schedule ) and infringe upon the rights and interests of female employees and underage employees. (Art. 23)
