China Announces 2024 State Compensation Standard for Violations of Personal Freedom

From 20 May 2024, the compensation standard is CNY 462.44 (approx. USD 63.75) per day, an increase of CNY 25.55 (approx. USD 3.5) compared to 2023.

In May 2024, China’s Supreme People’s Court (SPC) issued a notice stating that if a state organ or its personnel infringe upon a citizen’s personal freedom in the exercise of its functions and powers, such as illegally detaining a citizen, the state shall pay compensation to the citizen at the rate of CNY 462.44 per day based on the number of days the citizen’s freedom has been violated.

According to China’s State Compensation Law, where a state organ or its personnel infringe upon a citizen’s personal freedom, compensation payment for each day shall be calculated according to the State average daily wage of staff and workers in the previous year.

According to the National Bureau of Statistics announced on 17 May 2024, the annual average salary of non-private urban employees in 2022 is CNY 120,698, and the daily average salary is CNY 462.44.

Therefore, the compensation standard is CNY 462.44 in 2024.
