China Issues Draft Negative List for Market Access (2021)

On 8 Oct. 2021, the National Development and Reform Commission (NDRC) released the Negative List for Market Access (2021 Edition) (“Negative List (2021)”) (市场准入负面清单(2021年版)) (简称《负面清单(2021年)》) to seek public comments through 14 Oct.

The Negative List (2021) now includes six prohibited access items and 111 permitted access items, totaling 117 items, 6 items less than the 2020 version.

The Negative List (2021) specifies prohibitions on finance-related businesses as well as news and media-related businesses in violation of regulations.

In addition, the Negative List (2021) includes virtual currency mining among “backward production technology and equipment”, classifying it as eliminated and prohibiting investment in it, which serves as part of amendments based on the Catalogue for Guidance of Industrial Restructuring(产业结构调整指导目录).

In October 2021, the PBC and CBIRC jointly issued the “Regulations on Additional Supervision of Systemically Important Banks (For Trial Implementation)” (系统重要性银行附加监管规定(试行)), which constitutes the last piece of the puzzle of the systemically important banks regulatory system.

SPP Expands Disclosure Scope of Case Information

In September 2021, the SPP issued the revised “Provisions of the People’s Procuratorate on Case Information Disclosure” (人民检察院案件信息公开工作规定), which expands the scope of disclosure of case information by the procuratorates.
