China Regulates Takeout Marketing to Curb Food Waste

On 29 Nov. 2024, China’s State Administration for Market Regulation (SAMR) released the “Guidelines for Regulating Marketing Behaviors to Prevent Takeout Food Waste” (防范外卖餐饮浪费规范营销行为指引, hereinafter the “Guidelines”) to regulate the marketing behaviors of food delivery merchants and prevent food waste.

The Guidelines aims to guide food delivery merchants in addressing marketing behaviors that may lead to food waste and sets forth specific requirements to prevent food waste at various stages of the delivery process.

For example, the Guidelines encourages food delivery merchants to establish sound internal management systems to reduce raw material and finished product waste. It also requires that merchants set reasonable minimum order quantities and optimize discount mechanisms. The Guidelines further states that merchants are prohibited from producing, broadcasting, or distributing promotional content that encourages excessive consumption, such as live streams or videos promoting overeating or large portion sizes.
